29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:   a) On or about 8/28/15, on a  jobsite at the First Baptist Church of West Seneca, 511 Union Rd., West Seneca, NY:  Four employees were exposed to a fall of 20 ft. 7 in. from the work platform of an An Alum-A-Pole  Scaffolding System  ( pump jack scaffold)  that  was set up on the west side of the church.  The employees were removing old shingles and installing new roofing shingles on the mansard part of the roof.  The work platform was situated on the inside of the pole between the pole and the building wall, and was 20 ft. 7 in. above the ground.  A 12 in. wide  aluminum pik was installed on the outside of the pole, with the bottom of this pik 31 inches above  the work platform and the top of this pik 36 inches above the workplatform  leaving a vertical gap of 31 inches  between the two piks.  Proper guardrails require a top rail that is between 38  inches and  45 inches above a work level, and a mid-rail that is approx. half that distance.   The  12 in. wide  aluminum pik does not meet the specification for a guardrail, and no other fall protection system was utilized. Additionally, the north and south ends of the work platform had no fall protection system installed.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary:   a) On or about 8/28/15, on a  jobsite at the First Baptist Church of West Seneca, 511 Union Rd., West Seneca, NY:  Four employees were exposed to a fall of 20 ft. 7 in. from the work platform of an An Alum-A-Pole  Scaffolding System  ( pump jack scaffold)  that  was set up on the west side of the church.  The employees were removing old shingles and installing new roofing shingles on the mansard part of the roof.  The scaffold had 4 vertical poles, and a section set up between each pole. Each pole had multiple sections spliced together vertically for a total height of approx. 45 ft. for each pole.  Each pole was secured to the building using only a single triangular brace secured at the top of the building, a height of approx. 36 ft. 6 in.  Alum-A-Pole  Scaffolding System Set-Up Instructions require that  up to 24 ft., one roof or wall brace is required, and above 24 ft. in height, intermediate braces are required, with a maximum of 16 ft. vertical brace spacing anywhere on the pole or poles.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:   a) On or about 8/28/15, on a  jobsite at the First Baptist Church of West Seneca, 511 Union Rd., West Seneca, NY:  Two employees were installing the ice shield on the almost vertically pitched mansard roof on the west side of the church.  The employees were kneeling/standing at the edge of the upper flat roof and were leaning over the edge exposed to a fall of approx. 36 ft. 6 in., while installing the ice shield. No fall protection system was being utilized.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  a) On or about 8/28/15, on a  jobsite at the First Baptist Church of West Seneca, 511 Union Rd., West Seneca, NY:  Employees on this jobsite were exposed to hazards such as but not limited to fall hazards from a pump jack scaffold,  the edge of a roof,  and ladders.  No job site safety  inspection  was conducted  by  the employer  to identify these hazards and correct them before an accident and injuries could occur.     ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) On or about 8/28/15, on a  jobsite at the First Baptist Church of West Seneca, 511 Union Rd., West Seneca, NY:  There were two extension ladders  (north and south) placed so that employees could access the elevated 20 in. wide  aluminum scaffold planks (piks) used as a work platform on the Alum-A-Pole Scaffold. The siderails of the south extension ladder only extended  22 inches above the work platform which was 20 ft. 7 in. above the ground.      b) On or about 8/28/15, on a  jobsite at the First Baptist Church of West Seneca, 511 Union Rd., West Seneca, NY:  The siderails of the wooden ladder used to access  the roof at the southwest  corner  of the school building only extended 24 inches above the gutter which was 10 ft. 8in. above the ground.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) On or about 8/28/15, on a  jobsite at the First Baptist Church of West Seneca, 511 Union Rd., West Seneca, NY:  Employees  engaged in construction work including roofing work on a mansard roof were not trained to recognize potential hazards on this type of jobsite, including but not limited to falls from roofs, ladders, pump jack scaffolds, and the need for personal protective equipment to protect them from various hazards. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards.   ABATEMENT CERTIFICATION REQUIRED
