OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by objects such as but not limited to steel beams, the hoist, and lifted material in the event that a crane was overloaded.  a) Frame Shop, 72 East Market Street, Middleburg, PA - An overhead crane with an underhung bridge that moved along an east runway and west runway contained three (3) pendant controlled underhung hoists (located on the bridge, east runway, and west runway respectively) used to lift trailers for repairs was not marked to identify the rated load capacity exposing employees to struck-by hazards from an overloaded crane, as observed on or about September 5, 2015.

29 CFR 1910.23(c)(1): Open sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides.  or in the alternative  29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered.  a) Plant 1, 72 East Market Street, Middleburg, PA - Employees worked on top of modular home components without adequate protective equipment such as but not limited to guardrail systems, safety net systems, or personal fall arrest systems, were exposed to a fall hazard of approximately ten-foot (~10') onto a concrete floor, as observed on or about September 10, 2015.  b) Plant 2, 200 Custom Avenue, Middleburg, PA - Employees worked on top of modular home components without adequate protective equipment such as but not limited to guardrail systems, safety net systems, or personal fall arrest systems, were exposed to a fall hazard of approximately ten-foot (~10') onto a concrete floor, as observed on or about September 1, 2015.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation.

29 CFR 1910.304(b)(3)(ii)(C)(3): Each cord set, attachment cap, plug, and receptacle of cord sets, and any equipment connected by cord and plug found damaged or defective was used before being repaired:  a) Frame Shop, 72 East Market Street, Middleburg, PA - A battery charger attached to an energized cord set with exposed conductors within the damaged cord set receptacle was used by employees thereby exposing the employees to a contact with electrical current hazard, as observed on September 1, 2015.

29 CFR 1910.305(c)(4): Snap switches mounted in boxes did not have faceplates installed so as to completely cover the opening and seat against the finished surface.   a) North wall of Carpenter Shop in Sub-Assembly Building, 72 East Market Street, Middleburg, PA - On a daily basis, employees used a snap switch (light switch) to operate the fluorescent lights in the Carpenter Area which had a broken cover thereby exposing employees to a contact with electrical current hazard, as observed on or about September 1, 2015.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a) Sub-Assembly Building, 72 East Market Street, Middleburg, PA - Employees operated the Komatsu Forklift Truck Model FD 25T-12 (Serial No. 510298A) with front-end attachment eight-foot (8') extension forks without the manufacturer's prior written approval exposing employees to struck-by hazards created by the modifications to the powered industrial truck's lifting capacity and center of gravity, as observed on or about September 1, 2015.  b) Parking lot north of Plant 1, 72 East Market Street, Middleburg, PA - Employees operated the Komatsu Forklift Truck Model FG 30C-11 (Serial No. 492665A) with an inhouse shop-built front-end attachment (boom) without the manufacturer's prior written approval exposing employees to struck-by hazards created by the modifications to the powered industrial truck's lifting capacity and center of gravity, as observed on or about September 10, 2015.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation.
