29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    The employer did not establish an energy control program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated and rendered inoperable. 29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.    The employer did not have adequate point of operation guarding to prevent employees from having any part of their body in the danger zone during the operating cycle on the following machines:    a. Bailer/Compactor- The safety switch was disabled and allowed the employees to gain access to the bailer when it was in motion. This exposed employees to a crushing hazard.    b. Smart Product Band saws- There was no guarding in place to prevent employees from contacting the saw blade during operation.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.213(h)(1): The upper hood shall completely enclose the upper portion of the blade down to a point that will include the end of the saw arbor. The upper hood shall be constructed in such a manner and of such material that it will protect the operator from flying splinters, broken saw teeth, etc., and will deflect sawdust away from the operator. The sides of the lower exposed portion of the blade shall be guarded to the full diameter of the blade by a device that will automatically adjust itself to the thickness of the stock and remain in contact with stock being cut to give maximum protection possible for the operation being performed.    In the saw area, the lower exposed portion of the circular saw blade on the Dewalt radial arm saw was not guarded to the full diameter of the blade by a device that automatically adjusted itself to the thickness of the stock and remained in contact with the material being cut. This exposed employees to contact with the rotating blade.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.213(h)(4): Installation shall be in such a manner that the front end of the unit will be slightly higher than the rear, so as to cause the cutting head to return gently to the starting position when released by the operator. 29 CFR 1910.213(m)(1): The cutting heads of each wood shaper, hand-fed panel raiser, or other similar machine not automatically fed, shall be enclosed with a cage or adjustable guard so designed as to keep the operator's hand away from the cutting edge. The diameter of circular shaper guards shall be not less than the greatest diameter of the cutter. In no case shall a warning device of leather or other material attached to the spindle be acceptable.    Cutting heads of wood shaper(s) were not enclosed with a cage or adjustable guard so designed so as to keep the operator's hand away from the cutting edge. 29 CFR 1910.305(g)(1)(iii): If used as permitted in paragraphs (g)(1)(ii)(C), (g)(1)(ii)(G), or (g)(1)(ii)(I) of this section, the flexible cord shall be equipped with an attachment plug and shall be energized from an approved receptacle outlet.    The flexible cord used to supply power to the "notcher" (shaper) was wired directly to a disconnect box. This exposed employees to electric shock and/or burns in the event the cord was pulled from the wire terminals.
