29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about February 18, 2016, employees were exposed to occupational hearing loss while performing routine work activities in the Shop and the employer did not ensure the following employees participated in a continuing, effective hearing conservation program: (a) The Trim Saw Operator was exposed to noise at 153.0% of the permissible daily exposure (8-hour time weighted average of 80 dBA) or the equivalent sound level of approximately 92.9 dBA during a 366 minute sampling period on February 18, 2016. Exposure calculation includes a zero increment for the 114 minutes not sampled. (b) The Chop Saw Operator was exposed to noise at 77.0% of the permissible daily exposure (8-hour time weighted average of 80 dBA) or the equivalent sound level of approximately 88.0 dBA during a 360 minutes sampling period on February 18, 2016. Exposure calculation includes a zero increment for the 120 minutes not sampled. (c) The Radial Saw Operator was exposed to noise at 93.7% of the permissible daily exposure (8-hour time weighted average of 80 dBA) or the equivalent sound level of approximately 89.5 dBA during a 358 minutes sampling period on February 18, 2016. Exposure calculation includes a zero increment for the 122 minutes not sampled. (d) The Nail Gun Operator was exposed to noise at 89.3% of the permissible daily exposure (8-hour time weighted average of 90 dBA) or the equivalent sound level of approximately 89.2 dBA during a 357 minutes sampling period on February 18, 2016. Exposure calculation includes a zero increment for the 123 minutes not sampled. (e) The Band Saw Operator was exposed to noise at 121.1% of the permissible daily exposure (8-hour time weighted average of 90 dBA) or the equivalent sound level of approximately 91.3 dBA during a 355 minutes sampling period on February 18, 2016. Exposure calculation includes a zero increment for the 125 minutes not sampled. Abatement documentation is required in accordance with 29 CFR 1903.19(d).

29 CFR 1910.95(i)(5): The employer did not ensure proper initial fitting and supervise the correct use of all hearing protectors: On or about February 18, 2016, employees were required to wear hearing protection while performing work activities and employees were observed wearing hearing protection inserted incorrectly. The employer did not ensure employees were trained on the proper use of hearing protection to ensure optimal protection when employees were exposed to noise in excess of 90 dBA. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
