29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied.  The employer does not ensure that scaffold platforms are attached to the forks. This violation occurred on or about September 09, 2015, on the west side of the construction site where an employee was exposed to fall hazard while working in a scaffold platform that was elevated by a rough terrain forklift without the platform attached to the forks.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure that employees are not exposed to fall hazards.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems:  The employer does not ensure that employees are protected from falling while engaged in steel erection activities at heights greater than fifteen feet. This violation occurred on or about September 09, 2015, when employees were exposed to a fall hazard while installing metal sheeting on a roof that was 24 feet tall without fall protection.    Manuel Ceballos was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.760(a)(1), which was contained in OSHA inspection number 959503, citation number 1 item number 1 and was affirmed as a final order on March 19, 2014, with a final abatement date of March 03, 2014, with respect to a workplace located at 701 Teas Road, Conroe, TX 77303.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees performing steel erection activities are protected from falling.
