29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: On or about September 10, 2015, the employer failed to secure written approval from the manufacturers of their Powered Industrial Vehicles (Yale, Serial #N511521 and Hyster, Serial # D187V08407U) to use a metal service cage as a personnel carrier. The employer was using their PIVs to pick up the cage with an employee who just stands freely inside, to raise the employee so that they could pour product into Hopper #1.

Employees were standing freely inside a metal service cage and being lifted up by a PIV so that they could pour product into Hopper #1.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): On or about September 10, 2015, the employer failed to ensure that Powered Industrial Vehicles (Yale, Serial #N511521 and Hyster, Serial # D187V08407U) that were in need of repair, were removed from service. The Yale had an inoperable horn and the steering column was completely taped, up holding it together. The Hyster had a light out.
