29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. The Company did not establish and implement an energy control program consisting of energy control procedures, training, and periodic inspections.

29 CFR 1910.213(a)(9): All belts, pulleys, gears, shafts, and moving parts shall be guarded in accordance with the specific requirements of 1910.219. In the Production Area, on the Trim Saw Machine, (no manufacturer and model) an operator was exposed to an amputation hazard from the pulley belts, and chain and sprockets located approximately 3 ft. from the floor on the rear end of the machine.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. The employer did not report an in-patient hospitalization of an employee in that on or about September 9, 2015 an employee received amputation on a saw and was hospitalized from September 9, 2015 and discharged on September 12, 2015.
