29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:Note: If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented; On or about September 9, 2015, the employer failed to ensure that employees performing leading edge work, including the placement and securing of wood decking, were protected from falling to the level below as well as the ground level. No fall protection plan was in place and fall protection devices were not in place.
