OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards while working below the overhead conveyor system: a) Overhead Conveyor System, on or about 7/8/2015, employee was exposed to struck by hazard while cleaning a spill in the irregular pit by door #12 when a set of strapped tires (2) fell from the conveyor onto his back. The employer did not provide guarding or net system along the conveyor system. Among other methods, a feasible abatement method to correct this hazard is to comply with ASME B20.1-2012, Safety Standard for Conveyors and Related Equipment. a) Section 5.9.2 Guarding by Location or Position (d) Although overhead conveyors may be guarded by location, spill guards, pan guards, or equivalent shall be provided if material may fall off the conveyor and endanger personnel.

29 CFR 1910.120(q)(6)(i): First responders at the awareness level did not have sufficient training or have sufficient experience to objectively demonstrate competency in the areas covered by 29 CFR 1910.120(q)(6)(i)(A) through (q)(6)(i)(F): (a) On or about 9/16/2015, at facility, for the sorters that come across leaking packages, the employer does not let employees stop work and evacuate until the leaking package is identified and taken away.
