29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems or personal fall arrest systems:   a)  On or about September 16, 2015 and at times prior to, employees were observed walking/working on the roof of a three story apartment building repairing shingles.  The employees were not fall protected, exposing them to a fall hazard of about 30 ft. to the lower level ground.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access.  a)  On or about September 16, 2015 and at times prior to, employees were observed walking/working on the roof of a three story apartment building repairing shingles.  The employees used a 40 ft. ladder for access to the upper landing, the side rails did not extend at least 3 ft. above the upper landing surface to which the ladder was used to gain access,  exposing them to a fall hazard of about 30 ft. to the lower level ground.
