29 CFR 1910.95(d)(1): When information indicates that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer shall develop and implement a monitoring program. (a) The employer did not implement a Hearing Conservation program with all of its requirements (such as provision of suitable hearing protectors, medical monitoring, recordkeeping, and training). The Molder operating Press #13 in the Main Level of the Production Department was exposed to a cumulative noise dose of 166.4% during a 220 minute sampling period on December 8, 2015. This noise exposure equated to an 8-hour time weighted average sound level of approximately 92.2 dBA; the 8-hour time weighted average determination included zero increment for the unsampled 260 minutes.

29 CFR 1910.95(i)(2)(i): The employer did not ensure that hearing protectors are worn by an employee who is required by 29 CFR 1910.95(b)(1) to wear personal protective equipment: (a) On December 8, 2015 it was found that the Molder operating Press #13 was exposed to an 8-hour time weighted average of 92.2 dBA, and was not wearing hearing protection equipment to attenuate employee exposure to at least an 8-hour time-weighted average of 90 dBA as required by 29 CFR 1910.95(b).
