OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: a) Generator Room, on or about 9/17/2015: Guardrail system installed with height of 37-inches does not comply with the ANSI standard, employees are exposed to falls of up to twelve feet. b) Second Floor Eating Area, on or about 9/17/2015: Guardrail system installed with height of 34-inches does not comply with the ANSI standard, employees are exposed to falls of up to ten feet. c) Second Floor Eating Area, on or about 9/17/2015: Guardrail system installed with height of 38-inches does not comply with the ANSI standard, employees are exposed to ten feet. d) Manure Digester Area, on or about 9/17/2015: Employees were exposed to trips and falls due to openings on the guarding over the Weir's.
