29 CFR 1926.405(g)(1)(iii): Flexible cords and cables were used as a substitute for the fixed wiring of a structure:  a)    Cottrell Contracting Corporation, Vessel Marion: On or about 09/21/2015, an orange 100-foot flexible cord used to supply power to a portable exhaust fan was secured into the overhead cableway as a permanent source of power for portable tools and equipment.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:  a)    Cottrell Contracting Corporation, Vessel Marion: On or about 09/21/2015, an orange 100-foot flexible cord used to supply power to a portable exhaust fan was not provided with strain relief at the plug. The outer jacket of the cord was pulled away from to the male cord cap thus exposing employees to a possible electrical shock.  Cottrell Contracting Corporation was previously cited for a violation of an equivalent standard 29 CFR 1910.305(G)(2)(iii), which was contained in OSHA inspection number 917741, citation number 1 item number 2(c) and was affirmed as a final order on 08/21/2013, with respect to a workplace located at 328 N. Battlefield Blvd. Chesapeake, VA 23320.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours:  a)    Cottrell Contracting Corporation: An employee was hospitalized at Riverside Sentara Hospital located in Newport News, Virginia on August 31, 2015. The employer did not report the in-patient hospitalization to OSHA. Notification came from the U. S. Coast Guard on September 18, 2015.  No abatement certification or documentation required.

29 CFR 1926.59: 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  a)      Cottrell Contracting Corporation: On or about 09/21/2015, an employee required to use automotive and industrial grease among other chemicals was not provided with training in the new Global Harmonized System and labeling of chemicals.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
