OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in which equipment being utilized was not in accordance with consensus standards for the window washing industry. On or about 28 September 2015, and at times prior thereto, a Window Washer was suspended over the side of a four-story office building using a rope descent device while connected by a rope grab to a safety line that did not have an anti-panic feature, exposing the employee to a fall hazard of approximately 48 feet to the ground below. Additionally, the lanyard for the rope grab was in excess of two feet in length.

29 CFR 1910.28(j)(4): Workmen using boatswain's chairs were not protected by a safety life belt attached to a lifeline that was securely attached to substantial members of the structure (not scaffold), or to securely rigged lines, which would safely suspend the worker in case of a fall. On or about 28 September 2015, and at times prior thereto, an employee was performing window washing activities on a four-story office building while suspended from a Bosun's chair attached to a rope descent device in which the employee's lifeline was not anchored independent to the suspension rig, exposing the employee to a fall hazard of approximately 48 feet to the ground below.
