OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were allowed to work from Rope Descent Systems alone on multi-story buildings to perform window washing activities. [13785 Research Boulevard, Austin, TX 78750] On 2 September 2015, an employee was performing window washing activities at a four-story building without the assistance of a Helper or other personnel, exposing the employee to the lack of rescue capability.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours. [13785 Research Boulevard, Austin, TX 78750] On 2 September 2015, an accident occurred at a work site in which an employee suffered injuries to both heels requiring hospitalization and surgery. The in-patient hospitalization was not reported to the Austin Area Office of the Occupational Safety and Health Administration within twenty-four (24) hours.
