29 CFR 1926.1101(l)(2): Asbestos waste, scrap, debris, bags, containers, equipment, and contaminated clothing consigned for disposal was not collected and disposed of in sealed, labeled, impermeable bags or other closed, labeled, impermeable containers:  NORTH SIDE OF APARTMENT COMPLEX: On or about October 1, 2015 Varco did not collect asbestos waste, scrap, debris, bags, containers, equipment, and contaminated clothing consigned for disposal in sealed, labeled, impermeable bags or other closed, labeled, impermeable containers. Varco disposed of asbestos containing floor tile in an open-top roll-off dumpster.

29 CFR 1926.1101(g)(8)(i): For jobs removing vinyl and asphalt flooring materials which contain asbestos of for which buildings constructed no later than 1980, where the employer did not verify the absence of asbestos containing material pursuant to 29 CFR 1926.1101(g)(8)(i)(I), the employer did not ensure that employees complied with work practices described in 29 CFR 1926.1101(g)(8)(i)(A) through (g)(8)(i)(I) and that employees were trained in these practices pursuant to 29 CFR 1926.1101(k)(9):  APARTMENT COMPLEX: On or about October 1, 2015, and times prior thereto, employee(s) were exposed to respiratory hazards from mechanically removing asbestos containing material with no regard to airborne fiber controls, where the employer did not verify the absence of asbestos containing material while removing floor tile and mastic in room 112 in a building erected prior to 1980.  Varco Renovators was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1101(g)(8)(i), which was contained in OSHA inspection number 1016981, citation number 1, item number 1 and was affirmed as a final order on May 19, 2015 with respect to a workplace located at 123 Brackeridge Ave., San Antonio, TX 78209.

29 CFR 1926.1101(k)(3)(i): Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1):  APARTMENT COMPLEX: On or about October 1, 2015, before work in areas containing ACM and PACM was begun; Varco did not  identify the presence, location, and quantity of asbestos containing floor tile and/or PACM in Unit 112, pursuant to paragraph (k)(1)(i) of this section.   Varco Renovators was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1101(k)(3)(I), which was contained in OSHA inspection number 1016981, citation number 1, item number 2 and was affirmed as a final order on May 19, 2015 with respect to a workplace located at 123 Brackenridge Ave., San Antonio, TX 78209.
