OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to pressurized water while using a rotary gun without a safety catch: Location: Fairhaven Shipyard Employees were exposed to hazards from pressurized water while handling the rotary gun without a safety catch or other means to immobilize the trigger and prevent accidental operation.

29 CFR 1915.152(a): The employer did not provide or ensure each affected employee with the appropriate personal protective equipment (PPE) for the eyes, face, head, extremities, torso, and respiratory system, including protective clothing, protective barriers, personal fall protection equipment, and life saving equipment, meeting the applicable provisions of Subpart I, wherever employees were exposed to work activity hazards that required the use of PPE. Location: Fairhaven Shipyard Employer did not adequately access the hazards associated with all employees engaged in pressure water-jet cleaning operation and did not provide body protection to employees extremities while using water blasting equipment.
