29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a. On or before October 8, 2015, where employees used an aerial lift to access the roof, fall protection was not used, thereby exposing the employees to a 20 foot fall hazard.

1926.503(c): "Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where:  29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part. 29 CFR 1926.453(b)(2)(iv): Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position.    a. On or before October 8, 2015, where employees used an aerial lift to access the roof, the employees climbed over the top guardrail of the aerial lift platform, thereby exposing the employees to a 20 foot fall hazard.                 Lepi Enterprises, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(iv), which was contained in OSHA inspection number 485738, citation number 1, item number 3 and was affirmed as a final order on January 18, 2013, with respect to a workplace located at 199 W. Main Street, New Concord, OH, 43762.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.    a. On or before October 8, 2015, where employees were installing a roof on the sanctuary of a church, the employees were not protected from falls by the use of a guardrail system with toeboard, safety net system, or personal fall arrest system, thereby exposing the employees to a 16 foot fall hazard.     Lepi Enterprises, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 529259, citation number 1, item number 1 and was affirmed as a final order on January 14, 2013, with respect to a workplace located at 725 Steubenville Avenue, Cambridge, OH, 43725.
