29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  a. On or about October 08, 2015, at the above addressed jobsite, an employee was provided with and required to wear a full-face respirator for use during spraying operations. The employer did not develop or implement a written respirator program that included the provisions of this section including, but not limited to worksite specific procedures.  b. On or about October 16, 2015, at 4120 N Claremont Ave., Chicago, IL, an employee was provided with and required to wear a full-face powered air-purifying respirator for use during spraying operations. The employer did not develop or implement a written respirator program that included the provisions of this section including, but not limited to worksite specific procedures.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:  a. On or about October 08, 2015, at the above located jobsite, employees performing spray insulation operations were exposed to the hazards associated with chemicals such as, but not limited to methylene bisphenyl isocyanate. The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in paragraphs (f), (g) and (h) will be met.  b. On or about October 16, 2015, at 4120 N Claremont Ave., Chicago, IL, employees performing spray insulation operations were exposed to the hazards associated with chemicals such as, but not limited to methylene bisphenyl isocyanate. The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in paragraphs (f), (g) and (h) will be met.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  a. On or about October 16, 2015, at 4120 N Claremont Ave., Chicago, IL, an employee performing spray insulation operations was exposed to the hazards associated with chemicals such as, but not limited to methylene bisphenyl isocyanate. The employee was provided with polyester/latex gloves, which did not protect the employee from methylene bisphenyl isocyanate dermal absorption.
