29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii).  a.  On or about February 13, 2020, at the above addressed jobsite, an employee performing fireproofing operations from a tubular welded frame scaffold, approximately thirteen (13) feet above the lower level, did not have the working level fully planked, thereby exposing the employee to fall hazards.

On or about February 14, 2020, at the above addressed jobsite, the stairway on the north side of the building, where the treads and/or landings of pan stairs were to be filled in with concrete at a later date were not temporarily fitted with a solid material to the top edge of each pan, thereby exposing employees to tripping hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a.  On or about February 14, 2020, at the above addressed jobsite, employees conducting Fireproofing operations were exposed to falls from a height of eighteen (18) feet six (6) inches to the lower level due to the presence of unprotected edges on the upper level.  Rubens Spray Insulation, Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1204339, citation number 1, item number 5b, and was affirmed as a final order on April 25, 2017, with respect to a workplace located at 5 N. Oakley Ave. in Chicago, IL.  Rubens Spray Insulation, Inc. was previously cited for a violation of an equivalent occupational safety and health standard 29 CFR 1926.501(b)(14), which was contained in OSHA inspection number 1365476, citation number 2, item number 3, and was affirmed as a final order on March 20, 2019, with respect to a workplace located at 911 W. Randolph St. in Chicago, IL.
