OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from chainsaw use and operation: At the above addressed jobsite, employees working in a trench used a chainsaw to cut water main pipe. The chainsaw is designed to be used for cutting wooden objects only. Employees were thereby exposed to struck-by hazards resulting from chainsaw kickback during cutting operations. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
