OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards:    a)  On and about October 8, 2015, and times prior to, employees were exposed to fire hazards when mixing chemicals during cutting and scraping operations.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a)  On October 9, 2016, and times prior to, at the facility, where the employer's written Hazard Communication Program was not implemented in that a list of chemicals identifying all of the chemicals used in the company's seven work areas was not maintained by the Safety Coordinator; a master list of all of the chemicals used in the seven work areas was not maintained by the Safety Coordinator; and everyone who worked with or was potentially exposed to hazardous chemicals had not received initial training on the hazard communication standard by the Safety Coordinator.  Employees work with chemicals such as, but not limited to, MC 6500128, a corrosive, combustible liquid, and suspected reproductive toxin and carcinogen containing alkyl dimethylbenzylammonium and ethyl alcohol;  MC 6100198, a combustible liquid, irritant and suspected carcinogen containing petroleum naphtha and naphthalene; MC 6200027, an irritant containing phosphonic acid; and Clearbreak 861 (Oxyalkylated Phenolic Resin), a combustible liquid, irritant and possible carcinogen containing formaldehyde polymers with 4-nonylphenol, ethylene oxide, solvent naphtha, 1,2,4-trimethyl benzene and naphthalene.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:    (a)  On October 9, 2016, and times prior to, at the facility, used Intermittent Bulk Containers (IBC) were not labeled   with anything that conveyed the product identifier, the signal word, the hazard statement, the pictogram, and the precautionary statement, nor were the IBC labeled with anything that conveyed the product name and the appropriate hazard warning.   IBC contained MC 6500128, a corrosive, combustible liquid, suspected reproductive toxin and carcinogen containing alkyl dimethylbenzylammonium and ethyl alcohol; MC 6100198, a combustible liquid, irritant and suspected carcinogen containing petroleum naphtha and naphthalene; MC 6200027, an irritant containing phosphonic acid; Clearbreak 861 (Oxyalkylated Phenolic Resin), a combustible liquid, irritant and possible carcinogen containing formaldehyde polymers with 4-nonylphenol, ethylene oxide, solvent naphtha, 1,2,4 -trimethyl benzene and naphthalene.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    (a)  On October 9, 2016, and times prior to, at the facility, employees were not informed of the requirements of 29 CFR 1910.1200, the operations in their work area where hazardous chemicals were present, and the location and availability of the written hazard communication program.  Employees were not trained on the methods and observations that may be used to detect the presence or release of a hazardous chemicals in the work area, the measures employees can take to protect themselves, including specific procedures the employer has implemented, and the details of the employer's written hazard communication program.  Employees work with chemicals such as, but not limited to, MC 6500128, a corrosive, combustible liquid, and suspected reproductive toxin and carcinogen containing alkyl dimethylbenzylammonium and ethyl alcohol;  MC 6100198, a combustible liquid, irritant and suspected carcinogen containing petroleum naphtha and naphthalene; MC 6200027, an irritant containing phosphonic acid; and Clearbreak 861 (Oxyalkylated Phenolic Resin), a combustible liquid, irritant and possible carcinogen containing formaldehyde polymers with 4-nonylphenol, ethylene oxide, solvent naphtha, 1,2,4-trimethyl benzene and naphthalene.
