29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: (a) Charles Town: On or about October 15, 2015 and times prior, employees worked around a third floor access point, which was a 2ft. X 4ft. hole that measured approximately 10ft. to the next lower level, and did not have a fall protection system in place.

29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high. (a) Charles Town: On or about October 15, 2015 and times prior, employees were working on the third floor, near a door way on the exterior of the building that opened to floor joists of an unconstructed deck with a fall of approximately 10 feet to the next lower level. The doorway had a top rail mounted across the frame, but did not have a midrail installed leaving a gap of 37 inches between the bottom edge of the installed top rail and the walking/working surface.
