29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support:  On 10/22/2015, workers from Solomon Contracting, Inc. were performing roofing activities at a residential structure located at 1540 Pheasant Ridge, Ellisville, MO.   They were utilizing an access ladder improperly.  The ladder did not extend three feet above the upper landing (the edge of the roof).  Also, Solomon Contracting, Inc. was the General Contractor at the site and their subcontractor was performing roofing work and utilizing the same access ladder.

29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed:  On 10/22/2015, workers from Solomon Contracting, Inc. were performing roofing activities at a residential structure located at 1540 Pheasant Ridge, Ellisville, MO. The companys worker had been using a step ladder improperly.  The step ladder was not used in a manner for which it was designed.  The employee had been power washing a gazebo with an improperly positioned step ladder on 10/21/2015.  The step ladder was used in the closed (folded) position.  It was not opened with the side brackets properly locked.  Also, Solomon Contracting, Inc. was the General Contractor at the site and their subcontractor was performing roofing work and was gaining access to the second story roof by utilizing a step ladder in the closed (folded) position.    Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos, which you believe will be helpful. The abatement certification sheets are enclosed with the citation(s).

29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:    On 10/22/2014, employees from Solomon Contracting, Inc. were performing roofing work on the first story of a residential structure located at 1540 Pheasant Ridge, Ellisville. Louis, MO.  The employees were not wearing any type of eye protection while working on their roofing project with hand tools.  An employee had also been power washing a gazebo without any eye protection.  Solomon Contracting, Inc. was the General Contractor at the site and their subcontractor was performing roofing work without safety glasses while using pneumatic nail gun(s) and hammer(s).     The Solomon Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 989334, citation number 1, item number 2 and was affirmed as a final order on 11/04/2014, with respect to a workplace located at 708 S. Main St., St. Charles, MO.     Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos, which you believe will be helpful. The abatement certification sheets are enclosed with the citation(s).

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems:   On 10/22/2014, employees from Solomon Contracting, Inc. were working on a residential structure located at 1540 Pheasant Ridge, Ellisville, MO.  The employees were not protected by utilizing guardrail systems, a safety net system, or a personal fall arrest system.  The employee(s) observed was on the roof of the first story level of the residential structure without fall protection.  Also, Solomon Contracting, Inc. was the General Contractor at the site and their subcontractor was performing roofing work on the second story without any type of fall protection.   The Solomon Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 989334, citation number 1, item number 3b and was affirmed as a final order on 11/04/2014, with respect to a workplace located at 708 S. Main St., St. Charles, MO.  Abatement certification and abatement documentation is required for this violation.
