29 CFR 1910.133(a)(1): Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment: a) Newly Weds Foods, Inc., Chicago, IL did not ensure that affected employees in the seasoning sample lab in Research and Development were required to use eye protection when exposed to the hazard of eye contact with concentrated and/or irritant flavor extracts, including jalapeno chili, capsaicin and other chili pepper spices and seasonings in powder or oil form during the handling, adding, pouring, weighing, mixing and packaging of such flavoring complexes. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.138(a): The employer did not select and require employees to use appropriate hand protection when employees hands were exposed to hazardous condition: a) Newly Weds Foods, Inc., Chicago, IL did not require affected employees in the seasoning sample lab in Research & Development to wear gloves when exposed to the hazards of skin contact with substances and chemicals that may cause irritation and burning sensation to the skin, such as concentrated and/or irritant flavor extracts, including jalapeno chili, capsaicin and other chili pepper spices and seasonings in powder or oil form during the handling, adding, pouring, weighing, mixing and packaging of such flavoring complexes. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) Newly Weds Foods, Inc., Chicago, IL did not provide effective information and training to all employees in the seasoning sample lab in Research and Development on the hazardous chemicals, such as concentrated and/or irritant flavor extracts, including jalapeno chili, capsaicin and other chili pepper spices and seasonings in powder or oil form during the handling, pouring, weighing and mixing of such flavoring complexes in their work area. b) Newly Weds Foods, Inc., Chicago, IL did not provide all covered employees the required training on the revised elements of the Hazard Communication Standard for labels (e.g., pictograms and signal words) and the new format of the Safety Data Sheet (SDS) (i.e., section changes & section order and types of information contained within each section of the SDS), which was due December 1, 2013. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
