The most recent occurrence of this took place at the new home being built at 9003 N. 171st Street, Bennington, NE where the employer had an employee roofing this new residential home where the ground to eave is greater than 6 feet without the use of any form of fall protection.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer is failing protect employees from the hazards associated with improperly using portable extension ladders to roof a new residential home construction without using any forms of fall protection. The most recent occurrence of this took place at the new home being built at 9003 N. 171st Street, Bennington, NE where the employer had an employee using a 24 foot long aluminum extension ladder as means of access and egress for the roof on this new residential home. The ladder failed to extend at least three feet over the edge of the upper landing surface.
