29 CFR 1926.102(a)(2): Eye and face protective equipment being used did not used meet the requirements specified in Z 87.1-1968.                                                                                                           The employer is failing to protect employees from struck-by hazards associated with using pneumatic nail guns without wearing approved eye protection.  The most recent occurrence of this was observed July 26th, 2018 at the existing residential home located at 2990 N. 187th Court, Elkhorn, NE where the employer has employees using pneumatic nail guns to secure the shingles they were installing on the roof of a new apartment building project without wearing any ANSI approved eye protection.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  The employer is failing to train employees on recognition of fall hazards and the use of fall protection equipment.  The most recent occurrence of this was observed July 26th, 2018 at the new apartment building jobsite located at 2990 N. 187th Court, Elkhorn, NE where the employer has inadequately trained employees installing shingling on the roof of a new residential apartment building while exposed to fall hazards on a roof pitch greater than 4:12 and ground to eave closer to 28 feet without using any form of conventional fall protection.

29 CFR 1926.1060(a)(1)(i):  The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the nature of fall hazards in the work area   The employer is failing to train employees on the recognition of hazards associated with and use of an aluminum extension ladder as means of access/egress while performing residential construction activity.  The most recent occurrence of this was observed July 26th, 2018 at the new apartment building jobsite located at 2990 N. 187th Court, Elkhorn, NE where the employer has inadequately trained employees using an aluminum extension ladder to access and egress the roof they are working on without having extended the ladder a minimum of 3 feet over the upper landing surface or install a grab-rail.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems.                                                                                                           The employer is failing to protect employees from fall hazards associated with performing residential construction activity while exposed to falls 6 feet or greater.  The most recent occurrence of this was observed July 26th, 2018 at the new apartment building jobsite located at 2990 N. 187th Court, Elkhorn, NE where the employer has employees installing shingling on the roof of a new residential apartment building while exposed to fall hazards on a roof pitch greater than 4:12 and ground to eave closer to 28 feet without using any form of conventional fall protection.           Juan C. Cardenas dba Carlos Cardenas Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number1102203, citation number 1, item number 1 and was affirmed as a final order on November 20, 2015, with respect to a workplace located at 9003 N. 171st Street, Bennington, NE 68007.

29 CFR 1926.1053(b)(1):  Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder(s) was/were not secured at its top to a rigid support, and/or a grasping device, such as a grabrail, was not provided to assist the employees in mounting and dismounting the ladder:                                                                                                         The employer is failing to protect employees from fall hazards associated with improper use of an aluminum extension ladder as means of access/egress while performing residential construction activity.  The most recent occurrence of this was observed July 26th, 2018 at the new apartment building jobsite located at 2990 N. 187th Court, Elkhorn, NE where the employer has employees using an aluminum extension ladder to access and egress the roof they are working on without having extended the ladder a minimum of 3 feet over the upper landing surface or install a grabrail.      The Juan C. Cardenas dba Carlos Cardenas Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1102203, citation number 1, item number 2 and was affirmed as a final order on November 20, 2015, with respect to a workplace located at 9003 N. 171st Street, Bennington, NE 68007.
