29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) Assembly Area - The employer did not establish and implement a written respirator program to ensure that an employee who voluntarily wore a half-mask respirator at the vulcanization operation was medically able to use the respirator, and that the respirator was properly stored, cleaned and maintained, on or about October 29, 2015. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(1): Employees were not provided with effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) EMKA, Incorporated - Employee(s) were not provided with information on the location and availability of the safety data sheets, and were not provided with training on the physical and health hazards of the NBR-567 and NorMec vulcanizing film, on or about October 29, 2015. (b) EMKA, Incorporated - Employees are exposed to various chemicals, such as sulfuric acid from the batteries, and the employer did not provide employees with training on the revised hazard communication standard (HCS 2012) label elements and the new format and type of information on each section of the safety data sheets (SDSs) to ensure that when employees begin to see HCS 2012 compliant labels and SDSs in their workplace, employees understand how to use the labels and SDSs and access the information effectively, on or about October 29, 2015. No abatement certification or documentation required.
