The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.   a) On or about 10/27/15, at the front of the building, outside of the interior false roof area above the lobby area at the Ebenezer Square Apartment Building under construction , 2412 Seneca St., West Seneca , NY:  Two employees were exposed to potential fall of approx. 12 ft. while installing plywood sheeting on the outside of the building from the elevated "basket" of a  JLG aerial lift.  Both of the employees were wearing a full body harness, but neither of the employees was tethered to the boom or basket of the lift.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a) On or about 10/27/15, at the front of the building, outside of the interior false roof area above the lobby area at the Ebenezer Square Apartment Building under construction , 2412 Seneca St., West Seneca ,  NY:  One employee engaged in framing work was exposed to a fall of approx. between 11 ft. and 12 ft. respectively, from  unguarded edges on the front and back sides of the interior false roof area. The employee actually went through the unguarded opening and climbed into the elevated basket of an aerial lift that was just outside the area.  The employee was wearing a full body harness, but was not tethered to an anchor point.  No other fall protection system was utilized.     NO ABATEMENT CERTIFICATION REQUIRED
