29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors:   (a)  Located in buildway #1 adjacent to the new barge being painted: On or about and at times prior October 27, 2015  employees were potentially exposed to serious injury such as burns due to barrels of MEK (butanone) that were not grounded and bonded to prevent ignition of the flammable liquid from static electricity.

29 CFR 1910.106(e)(6)(ii): Class I flammable liquid(s) were dispensed into containers without electrically interconnecting the nozzle and the container:  (a)  Located in buildway #1 adjacent to the new barge being painted: On or about and at times prior October 27, 2015 the inspection revealed that employees were potentially exposed to serious injury due to MEK being dispensed into containers without the nozzle and container being electrically interconnected as required.

29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location:  (a)  Located in buildway #1 at the new barge being painted: On or about and at times prior October 27, 2015 energized string lights used to illuminate stairway access onto the barge were not approved for Class 1, Division 1 location and were energized while the barge was being painted with a flammable paint.

29 CFR 1910.134(d)(1)(iii) is applicable to shipyard employment by 1915.154 that incorporates the General Industry requirement: The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:   (a) Located in the open area of bay #6: On or about and at times prior to January 6, 2016 the employer did not evaluate employee exposure to heavy metals in welding fume, including but not limited to exposure to manganese. Employees were potentially exposed to serious health effects including central nervous system damage and adverse reproductive health effects from the failure to wear respirators during welding operations in the open area of the bay when welding on mild steel.    (b) Located at buildway #1 at the new barge being painted:  On or about and at times prior to October 29, 2015 the employer did not evaluate employee exposure to xylene and other chemicals during spray paint application work processes.
