29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. On or about November 3, 2013, at a job site located at 1413 Amherst Rd NE, Massillon, Ohio 44646; during commercial store front surfacing activities, the employer did not ensure all employees using an aerial lift were protected from fall hazards approximately 9.2 feet by a fall protection device. 29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: On or about November 3, 2015, during the installation of fascia material, the employer did not conduct frequent and regular inspections of the job site where employees were exposed to fall hazards from a height of approximately 9.2 feet.
