29 CFR 1926.300(b)(4)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle:   On or about 11/03/2015, employee(s) from Vincent Realmuto was installing a roof of a new residential building located at 9828 Old Warson Road, Ladue, MO.   The DeWalt Table Saw (DW744) was being used to cut wood for the installation of a wood shake roof without a blade guard.  The table saws blade extended approximately 1 inch above the saws table top.    Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos, which you believe will be helpful. The abatement certification sheets are enclosed with the citation(s).

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems:   On or about 11/03/2015, roofers working Vincent Realmuto were working on the roof of a new residential structure located at 9828 Old Warson Road, Ladue, MO.  The roofers were not utilizing guardrail systems, a safety net system, or a personal fall arrest system.  The workers were observed on the roof of the building without fall protection, exposing them to a fall to the ground below.  Roof to ground measured approximately 9 feet 10 inches on an approximate 7:12 pitched roof.    Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos, which you believe will be helpful. The abatement certification sheets are enclosed with the citation(s).

29 CFR 1926.1053(b)(22): An employee shall not carry any object or load that could cause the employee to lose balance and fall.  [55 FR 47689, Nov. 14, 1990; 56 FR 2585, Jan. 23, 1991; 56 FR 41794, Aug. 23, 1991]:   On or about 11/03/2015, roofers working for Vincent Realmuto were roofing a residential structure located at 9828 Old Warson Road, Ladue, MO.  Workers were carrying roofing materials up a ladder, which could have caused them to loose balance and fall.    Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos, which you believe will be helpful. The abatement certification sheets are enclosed with the citation(s).
