29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck.  On or about 11/5/15, throughout the fabrication shop and yard; the employer allowed employees to operate the Toyota Propane fork trucks (Model 7FGU30 Serial #64436) without documentation that the operators had successfully completed the training required by this standard.

29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by rotating parts and flying chips and point of operation   a) On or about 11/5/2015; in the Northwest corner of the shop; the employer allowed employees to operate the Johansson Drill Press (Serial #11127) without a guard around the chuck and bit;  b) On or about 11/5/2015; in the middle South side of shop; the employer allowed employees to operate the Adira Hydraulic Press (Model QHD-15040 Serial 48078997) without a guard to prevent entry by reaching through, over, under and around the point of operation.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  On or about 11/5/2015; middle south side of the shop, the employer allowed employees not to lockout the Adira Shear (Model #GHS 0630; Serial #32838896D) when the die is changed every two years. A lockout program was not developed nor implemented.
