OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a) Haysite Reinforced Plastics.  On or about November 3, 2015, employees were potentially exposed to fire and explosion hazards from dust collectors located inside the building.  The dust collectors collected combustible dust from materials including, but not limited to, Molded Epoxy Shapes and Glass Reinforced Thermoset Polyester Molded Sheets.  The dust collectors were not equipped with any devices to mitigate a potential dust explosion but were located inside the building.  The dust collectors include, but are not limited to:            (1) Puller #5, Dust Collector 2: Aercology 5104-118           (2) Puller #6 Dust Collector: Donaldson Torit Downflo DFO 2-4          (3) Compression Molding, Dust Collector 4          (4) Shear, Saw, Sand Area, Dust Collector 6: Dantherm Filtration System          (5) Epoxy Lab, AGET Dustkop     b) Haysite Reinforced Plastics, Dust Collector 1, between Puller Area and Mixing Room.  On or about November 3, 2015, employees were potentially exposed to fire and explosion hazards from the AAF Fabri-Pulse Design "M" (Model 2) dust collection system which was located inside the building and was equipped with an explosion relief vent.  Materials collected by the system include flammable vapors from products used in the mixing process that include, but are not limited to, Styrene and Acetone.  In the event of an explosion, the explosion relief vent would blow-out into the walkway between the Puller Area and Mixing Room.      c) Haysite Reinforced Plastics.  On or about November 3, 2015, employees were potentially exposed to fire and explosion hazards from dust collectors that were not equipped with devices and systems to prevent the propagation of explosions and associated flame fronts from dust collectors through the associated dust collection system ductwork.  The dust collectors collected combustible dust from materials including, but not limited to, Molded Epoxy Shapes, Glass Reinforced Thermoset Polyester Molded Sheets.  The dust collectors were not equipped with approved devices to prevent the propagation of a dust explosion and associated flame fronts throughout the dust collection system and associated ductwork.  The dust collectors include, but are not limited to:            (1) Puller #5, Dust Collector 2: Aercology 5104-118           (2) Puller #6 Dust Collector: Donaldson Torit Downflo DFO 2-4          (3) Compression Molding, Dust Collector 4          (4) Shear, Saw, Sand Area, Dust Collector 6: Dantherm Filtration System          (5) Epoxy Lab, AGET Dustkop

On or about November 3, 2015, employees were potentially exposed to fire and explosion hazards from the Dantherm Filtration System Dust Collector that was not maintained dust-tight.  The dust collector collected combustible dust from materials including, but not limited to, Glass Reinforced Thermoset Polyester Molded Sheets.      b) Haysite Reinforced Plastics - Shear, Saw, Sand Area.  On or about November 3, 2015, employees were potentially exposed to fire and explosion hazards from the dust collection system that was not effectively capturing fugitive dust created at the saw.  The combustible dust was generated from the sawing of materials including, but not limited to, Glass Reinforced Thermoset Polyester Molded Sheets.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, and service rooms were not kept clean and orderly and in a sanitary condition:       a) Shear, Saw, Sand Area.  On or about November 3, 2015, combustible dust had accumulated on overhead surfaces, electrical equipment and other surfaces throughout the work area.  Combustible dust was created during sanding and machining of the companys products, including, but not limited to the Glass Reinforced Thermoset Polyester H1000 Molded Sheets and H261 Molded Sheets.  The accumulation of the combustible dust created explosion and fire hazards.

29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location:     a) Shear, Saw, Sand Area.  On or about November 3, 2015, the electrical equipment used in the Shear, Saw, Sand Area was not safe for the Class II hazardous location in that combustible dust accumulated in and on the electrical equipment and in the general area.  The combustible dust was created during sanding and machining of the companys products, including, but not limited to the Glass Reinforced Thermoset Polyester H1000 Molded Sheets and H261 Molded Sheets.

On or about November 3, 2016, the flexible cord to the buffer was damaged, in that the outer sheathing was torn, exposing the inner wires of the cord.

Employees were not trained on the hazards associated with the combustible dust that is created during machining of the company's products such as, but not limited to, the Epoxy Molded Shapes, Glass Reinforced Thermoset Polyester H100 Molded Sheets and H261 Molded Sheets (Glass Reinforced Thermoset Polyester.
