29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job sites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):     (a)Peska Construction, Inc. @ 4024 N. Hercules Ave., Sioux Falls, SD 57104: On or about November 12, 2015, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. An employee was working in a JLG 660 SJ without the use of a fall protection system.  This condition exposed an employee to a fall hazard of approximately 15 feet to the ground below.        Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:       (a) Peska Construction, Inc. @ 4024 N. Hercules Ave., Sioux Falls, SD 57104:  On or about November 12, 2015, an employee was working from the basket of an JLG 660 SJ aerial lift without the use of a fall protection system. This hazard exposed the employee to a fall of approximately 15 feet.       Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part 1926.502(d) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).
