On or about November 17, 2015, in a 9-foot deep excavation, three employees with Capital City Contracting, LLC. were not protected from a cave-in hazard by use of a adequate protective system, such as a trench box, sloping or benching measures.

29 CFR 1926.652(c)(3)(iii): A copy of the tabulated data used to construct the protective system used at the jobsite, identifying the Professional Engineer who approved the data, was not made available upon request: a. On or about November 17, 2015, a trench box being used in an excavation did not have the tabulated data sheet nor operating manual which would have specified the assembly and use of the protective system, exposing employees to a collapse hazard.
