Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards: (a) On or about November 13, 2015, for the employee who sustained injuries while operating a Cincinnati 1000 Series Hydraulic Shear, Serial No. 50739 where the metal part placed in the shear tipped up, permitting the employee's fingers under the part as it was clamped down on the shear table at 210 First Avenue NE, Gwinner, North Dakota. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be to implement engineering controls such as, but not limited to: backstops, change in routing, and/or square arm controls for the Cincinnati 1000 Series Hydraulic Shear.
