29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a.) Kenneth Snider, Inc., On or about 11/19/15, the employer did not implement a continuing, effective hearing conservation program for an employee (Log Turner), who was exposed to noise at an eight-hour time weighted average of 89.2 dBA which is 104.9% greater than the action level of 85 dBA during the 373 minute sampling period on 11/19/15. b.) Kenneth Snider, Inc., On or about 11/19/15, the employer did not implement a continuing, effective hearing conservation program for an employee (Edger Operator), who was exposed to noise at an eight-hour time weighted average of 94 dBA which is 110.5% greater than the action level of 85 dBA during the 375 minute sampling period on 11/19/15. c.) Kenneth Snider, Inc., On or about 11/19/15, the employer did not implement a continuing, effective hearing conservation program for an employee (Cutoff Saw), who was exposed to noise at an eight-hour time weighted average of 90.8 dBA which is 106.8% greater than the action level of 85 dBA during the 366 minute sampling period on 11/19/15.

29 CFR 1910.95(i)(2)(i): The employer did not ensure that hearing protectors are worn by an employee who is required by 29 CFR 1910.95(b)(1) to wear personal protective equipment: a.) Hearing protection was not worn by an employee (Edger Operator), exposed to noise at 104.3% of the permissible daily noise exposure (eight-hour time weighted average of 90 dBA) during the 375 minute sampling period on 11/19/15. For a full eight hour shift, this exposure would be equivalent to an average sound level of 93.9 dBA. Exposure calculations include a zero increment for the 105 minutes not sampled.
