29 CFR 1910.178(p)(1): Powered industrial trucks found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating conditions: (a) Worksite: On or about 11/23/2015, the employer did not ensure that a Raymond High-Level Order Picker, with a damaged guard in the operator compartment, was taken out of service due to defects. The Home Depot was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.178(q)(1), which was contained in OSHA inspection number 956370, citation number 002, item number 01 and was affirmed as a final order on 5/21/2015, with respect to a workplace located at 3500 N. Kimball, Chicago Illinois, 60618.
