29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):     a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on November 23, 2015, when employees are working on a residential roof at 8151 Cesperdes Avenue, Jacksonville Florida 32217 without fall protection and are exposed to falls of approximately 8 to 13 feet.    K&D Roofing & Construction Co., Inc., previously committed a repeat violation of this standard on October 15, 2014, with respect to a workplace at 13167 Wexford Hollow Road North, Jacksonville, FL 32224, which became a final order on November 14, 2014 (Inspection No. 1000650).      K&D Roofing & Construction Co., Inc., previously committed a serious violation of this standard on November 8, 2012, with respect to a workplace at 4901 Atlantic Blvd., Jacksonville, Florida 32207, which became a final order on November 27, 2013 (Inspection No. 729481).     K&D Roofing & Construction Co., Inc., previously committed a repeat violation of this standard on December 2, 2011, with respect to a workplace at 1852 & 1837 Blue Bonnet Way, Orange Park, Florida 32003, which became a final order on March 21, 2012 (Inspection No. 315482257).    K&D Roofing & Construction Co., Inc., previously committed a serious violation of this standard on September 27, 2011, with respect to a workplace at 13714 Bromley Point Dr., Jacksonville, Florida 32224, which became a final order on November 11, 2011 (Inspection No. 315480319).
