29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: a) Eastchase Apartments Bldg #16 at Berryhill Road, Montgomery AL; On or about November 17, 2015 the employer exposed his employees to fall hazards in that employees were allowed to work 10 feet above the ground from an articulated boom lift without fall protection (safety harness and lanyard).

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) East Chase Apartments Bldg #16 at Berryhill Road, Montgomery AL - (Second Floor); On or about November 17, 2015 the employer exposed his employees to fall hazards in that employees were allowed to work on the second level of an apartment building balcony that had an unprotected edge exposing employees to a 10 foot 7 3/4 inch fall to the next level.
