29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: A.) BWP Hardwoods, Inc., 12942 US Route 322, Brookville, PA 15825, on or about November 25, 2015 and times prior thereto: An employee was accessing the roof of the mill building to perform work operations that included, but were not limited to, directing/signaling a crane operator for the re-installation of band mill/head saw parts that included, but were not limited to, a band saw wheel and hood. The employee was exposed to a fall hazard of 17.1 feet to the ground below. This employee was not protected by any guardrail systems and/or other fall protection devices. IN THE ALTERNATIVE: 29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: A.) BWP Hardwoods, Inc., 12942 US Route 322, Brookville, PA 15825, on or about November 25, 2015 and times prior thereto: An employee was accessing the roof of the mill building to perform work operations that included, but were not limited to, directing/signaling a crane operator for the re-installation of band mill/head saw parts that included, but were not limited to, a band saw wheel and hood. The employee was exposed to a fall hazard of 17.1 feet to the ground below. The employee was exposed to a fall hazard of 17.1 feet through the opening in the roof to the ground below. This employee was not protected by any guardrail systems and/or other fall protection devices. The fall protection system was designed / rigged where by the employee could free fall through the roof opening. The body belt was not authorized and designed for fall arrest conditions.

BWP Hardwoods, Inc., 12942 US Route 322, Brookville, PA 15825, on or about November 20, 2015 and times prior thereto: An employee was accessing the roof of the mill building to perform work operations that included, but were not limited to, removal of metal sheeting for the removal of band mill/head saw part that included, but were not limited to, a band saw wheel and hood. The employee was exposed to a fall hazard of 17.1 feet to the ground below. This employee had rigged a system of fall protection consisting of 3/8-inch twisted polypropylene rope that was not designed by the manufacturer for fall protection purposes. A.) BWP Hardwoods, Inc., 12942 US Route 322, Brookville, PA 15825, on or about November 20, 2015 and times prior thereto: An employee was accessing the roof of the mill building to perform work operations that included, but were not limited to, removal of metal sheeting for the removal of band mill/head saw part that included, but were not limited to, a band saw wheel and hood. The employee was exposed to a fall hazard of 17.1 feet to the ground below. This employee had rigged a system of fall protection consisting of a body belt. The fall protection system was designed / rigged where by the employee could free fall through the roof opening. The body belt was not authorized and designed for fall arrest conditions.
