29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:   a) Route 40 and Salem Church Road, Bear, DE - On or about November 25, 2015, masons were using plastic buckets filled with stucco while working from a tubular welded frame scaffold, approximately 18 feet above grade, but the ground workers were not wearing any type of head protection.

29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights.  a) Route 40 and Salem Church Road, Bear, DE - The employer does not ensure that each supported scaffold working level is fully planked between the platform and the uprights. This continuing violation was most recently observed on November 25, 2015, when employees performing stucco application did not have fully planked working surfaces. The employer's ongoing obligation is to ensure that all tubular welded frame scaffolding working levels are fully planked between the platform and the uprights.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.    a) Route 40 and Salem Church Road, Bear, DE - The employer does not ensure that safe means of scaffold access and egress are available for every employee. This continuing violation was most recently observed on November 25, 2015, when employees performing stucco application were climbing scaffold endframes to a working height in excess of ten feet, which did not have an integral ladder. The employer's ongoing obligation is to ensure that all tubular welded frame scaffolding working levels are provided with a safe means of access and egress during routine scaffold use.

This continuing violation was most recently observed on November 25, 2015, when employees performing stucco application were working from tubular welded frame scaffolds in excess of ten feet above a lower level, which featured multiple unguarded edges. The employer's ongoing obligation is to ensure that all tubular welded frame scaffolding working levels are outfitted with the components necessary to prevent employees from falling to a lower level.

This continuing violation was most recently observed on November 25, 2015, when employees performing stucco application were working from tubular welded frame scaffolds in excess of ten feet above a lower level, which was missing multiple sets of guardrails. The employer's ongoing obligation is to ensure that all tubular welded frame scaffolding working levels are provided guardrails to prevent employees from falling to a lower level.

This continuing violation was most recently observed on November 25, 2015, when employees performing stucco application were working from tubular welded frame scaffolds without receiving hazard reduction training from a competent person. The employer's ongoing obligation is to ensure that all employees working from tubular welded frame scaffolding receive instruction to assist in their understanding of hazard reduction techniques.
