OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards: (a) On or about 11/23/15, parking lot entrance at 9020 Bailey Cove Road, Huntsville, AL, the employer did not ensure that employees were adequately protected in a work zone in that: a) A taper length was not provided using the cones in the work zone leading to the parking lot connection with the road way. The traffic cones were positioned in a non-standard way at the road way edge. b) A flagger was not positioned in advance to alert and slow the traffic. c) The employer did not have a Traffic Control Plan (TCP) for this work activity or job site.
