OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to combustible dust explosion, deflagration, or other fire hazards;     (a) Powder coating room for line A - On or about November 23, 2015, the employer had not performed applicable evaluations such as but not limited to a process hazard analysis on the powder coating room and powder coating system and ducts to determine what deflagration/explosion controls were required as found in NFPA 654 and other applicable industry standards. The dust sample sent to the Salt Lake Testing Center was found to be positive for explosibiltiy and Class II dust.

(a) Receiving steel room - On or about November 23, 2015, the West below-the-hook lifting device used to lift bundles of steel rods was not marked or had an inspection plate which listed the information below.    (b) Receiving steel room - On or about November 23, 2015, the East below-the-hook lifting device used to lift coils of steel rods or flat stock was not marked or had an inspection plate which listed the information below.      ASME B30.20 requires mechanical lifting devices shall be marked with, but not limited to, the following information:        - Manufacturers name and address        - Serial number        - Lifter weight, if over 100 lb.
