29 CFR 1910.23(a)(3): The employer did not ensure that every hatchway and chute floor opening was guarded by either a hinged floor opening cover of standard strength and construction equipped with standard railings or permanently attached thereto so as to leave only one exposed side, or by a removable railing with toe board on not more than two sides of the opening and fixed standard railings with toe boards on all other exposed sides: On the day of the inspection on the second floor of the grain mill there was a hinged cover over a equipment access opening in the flooring. The hatchway cover was made of 1/4 inch plywood that is not of standard strength. An employee who walked on the hatch would break through the cover. Employees worked on this level on or about November 23, 2015.

29 CFR 1910.24(b): Fixed stairs were not provided for access from one structure level to another where operations necessitated regular travel between levels, and for access to operating platforms at any equipment which requires attention routinely during operations: No stairway was installed to allow access from the second floor mixing area. To reach this area employees had to step 16 inches down onto a concrete block while bending down under a 39 inch high cross beam. Employees used this concrete block to reach the area on or about November 23, 2015.

A continuing and effective extermination program was not instituted where rodents, insects or other vermin were detected: On the South side of the building numerous rat burrows were visible between the building wall and the ground surface and between the loading dock wall and the ground. The extermination program was not effective; a live rat was observed running from under the building.
