29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On an apartment building, on or about December 2, 2015, and at times prior thereto,  employees were exposed to fall hazards greater than 6 feet to the concrete ground below:  (a) Building Type III, Club House: while installing floor trusses on a residential apartment building under construction without fall protection.  (b) Building Type III, Building 7: while installing roof trusses on a residential apartment building under construction without fall protection.     (c) Building Type III, Building 7:  while walking across a 2 x 11 inch board which was not 18 inches wide and did not have guardrails installed.

29 CFR 1926.503(c): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section:  At an apartment complex under construction, on or about December 2, 2015, and at times prior thereto, employees were exposed to a fall hazard greater than 6 feet to the paved ground below, while not being trained on the procedures to recognize fall hazards.
