29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: CORNER OF ZANDERSON AVE & POPLAR ST: On or about December 2, 2015, employees were exposed to the struck-by and caught-in hazard while installing a new sanitary sewer line under Zanderson Ave inside and excavation without prior inspection by a competent person.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that: CORNER OF ZANDERSON AVE & POPLAR ST: On or about December 2, 2015, employees were exposed to the struck-by and caught-in hazard of an unprotected trench while installing a new sanitary sewer line under Zanderson Ave. The Qro Mex Construction Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR1926.652(a)(1) which was contained in OSHA inspection number 1071550, citation number 1, item number 2 and was affirmed as a final order on 10/21/2015, with respect to a workplace located at South Stone Ave. & Marion St., Laredo, TX 78040.
