OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about 12/03/2015, employee(s) working at Champion Precast Inc. located at 2441 Hwy 61 N, Troy, MO, were exposed to a struck-by hazard.  The employer had various forklift operators operating their lifts without seat belt protection.  One such forklift was a Caterpillar 175, Model: DP80, S/N: 1DP00194.  The Letter of Interpretation dated March 7, 1996 addresses this condition and references ASME B56.1-1993.    One method of abatement is for the employer to ensure that employees do wear their seat belts while operating the Power Industrial Trucks (forklifts) and that the employer follows ASME B56.1-1993.
