OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about 12/03/2015, employee(s) working at Champion Precast Inc. located at 2441 Hwy 61 N, Troy, MO, were exposed to a struck-by hazard.  The employer had various forklift operators operating their lifts without seat belt protection.  One such forklift was a Caterpillar 175, Model: DP80, S/N: 1DP00194.  The Letter of Interpretation dated March 7, 1996 addresses this condition and references ASME B56.1-1993.    One method of abatement is for the employer to ensure that employees do wear their seat belts while operating the Power Industrial Trucks (forklifts) and that the employer follows ASME B56.1-1993. 29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed:     On or about 12/03/2015, at Champion Precast Inc., located at 2441 Hwy 61 N, Troy, MO, the employer did not conduct periodic inspections of their Lockout/Tagout Program.  No records could be produced.  In their Lock-Out/Tag-Out Program, under Section E. Periodic Inspections, it states that periodic inspection must be conducted annually and be performed by an authorized employee.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years:    On or about 12/03/2015, employees working at Champion Precast Inc. located at 2441 Hwy 61 N, Troy, MO, were operating forklifts without having completed the required refresher training.  The last time all the operators were trained was dated 2/24/11.

29 CFR 1910.179(g)(1)(v): Pendant control boxes shall be constructed to prevent electrical shock and shall be clearly marked for identification of functions:     On or about 12/03/2015, employees working at Champion Precast Inc. located at 2441 Hwy 61 N, Troy, MO, employees operated the 10 ton Gaffey crane on the east side of the new plant with a control pendant that had control buttons not legibly marked for the respective function.

29 CFR 1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.):     On or about 12/03/2015, employee(s) working at Champion Precast Inc. located at 2441 Hwy 61 N, Troy, MO, were exposed to struck-by hazards.   The tongue guard on a Dayton Industrial bench grinder (Model: 2Z341P) was missing and therefore could not be adjusted to one-fourth inch.

You must enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred:   On or about 12/03/2015, an employee working at Champion Precast Inc. located at 2441 Hwy 61 N, Troy, had an injury and the employer failed to appropriately maintain their year-to-date OSHA 300 Log for FY 2015.
