29 CFR 1926.501(b)(10): 29 CFR 1926.501(b)(10):   Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:    (a) Construction Site - On or about December 4, 2015 employees were exposed to a fall hazards of 19'6" while removing parapet wall (gravel guard) and vapor barrier from interior edge of roof above courtyard without using fall protection to prevent falls to a lower level.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:     (a) Construction Site - On or about December 4, 2015 two employees exposed to fall hazards in the workplace had not received training on how to recognize, eliminate and prevent fall hazards.

29 CFR 1926.503(a)(2)(viii): The employer did not assure that each employee had been trained by a competent person qualified in the standards contained in subpart M:  (a) Construction Site -  On or about December 4, 2015 the employer representative who provided fall protection training to some of the employees exposed to fall hazards on site did not know the requirements for fall protection related to the work activities employees were performing on site.  The trainer thought that provisions allowed for roofing work applied to the construction/installation of rafters and roof decking.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident:    Construction Site - On or about December 4, 2015 at approximately 2:24pm employee David Mooney was pronounced dead as the result of a fall in the workplace.  OSHA was notified of the event on December 5, 2015 at 12:55am.
